12 The upstream source is generated from a Git tag for the corresponding
13 upstream release, but with the WINNT directory removed to reduces the size
14 of the upstream tarball by about 8MB.

16 The source package contains the OpenAFS documentation as distributed by
17 the OpenAFS project, some of which does not include the original source.
18 These documents were originally created using TeX internally by Transarc,
19 the original authors of AFS. By the time that AFS was released as free
20 software by IBM after acquiring Transarc, the original source could no
21 longer be found. It has apparently been lost over the years.

23 Although these HTML and PDF files would not normally be considered source,
24 they're all that's available until they can be rewritten and updated in
25 some better format. They have been released under the IBM Public License
26 Version 1.0 (included below), the same license as the rest of OpenAFS.

28 Normally, this documentation could not be included in Debian without being
29 accompanied by the original TeX source and build tools under DFSG#2, but
30 under the circumstances, these files essentially are the source, as
31 they're all that anyone has.

87 2. GRANT OF RIGHTS
88 a) Subject to the terms of this Agreement, each Contributor hereby
89 grants Recipient a non-exclusive, worldwide, royalty-free
90 copyright license to reproduce, prepare derivative works of,
91 publicly display, publicly perform, distribute and sublicense the
92 Contribution of such Contributor, if any, and such derivative
93 works, in source code and object code form.

95 b) Subject to the terms of this Agreement, each Contributor hereby
96 grants Recipient a non-exclusive, worldwide, royalty-free patent
97 license under Licensed Patents to make, use, sell, offer to sell,
98 import and otherwise transfer the Contribution of such
99 Contributor, if any, in source code and object code form. This
100 patent license shall apply to the combination of the Contribution
101 and the Program if, at the time the Contribution is added by the
102 Contributor, such addition of the Contribution causes such
103 combination to be covered by the Licensed Patents. The patent
104 license shall not apply to any other combinations which include
105 the Contribution. No hardware per se is licensed hereunder.

107 c) Recipient understands that although each Contributor grants the
108 licenses to its Contributions set forth herein, no assurances are
109 provided by any Contributor that the Program does not infringe the
110 patent or other intellectual property rights of any other entity.
111 Each Contributor disclaims any liability to Recipient for claims
112 brought by any other entity based on infringement of intellectual
113 property rights or otherwise. As a condition to exercising the
114 rights and licenses granted hereunder, each Recipient hereby
115 assumes sole responsibility to secure any other intellectual
116 property rights needed, if any. For example, if a third party
117 patent license is required to allow Recipient to distribute the
118 Program, it is Recipient's responsibility to acquire that license
119 before distributing the Program.

121 d) Each Contributor represents that to its knowledge it has sufficient
122 copyright rights in its Contribution, if any, to grant the
123 copyright license set forth in this Agreement.

125 3. REQUIREMENTS

127 A Contributor may choose to distribute the Program in object code form
128 under its own license agreement, provided that:
129 a) it complies with the terms and conditions of this Agreement; and

131 b) its license agreement:

133 i) effectively disclaims on behalf of all Contributors all warranties
134 and conditions, express and implied, including warranties or
135 conditions of title and non-infringement, and implied warranties
136 or conditions of merchantability and fitness for a particular
137 purpose;

139 ii) effectively excludes on behalf of all Contributors all liability
140 for damages, including direct, indirect, special, incidental and
141 consequential damages, such as lost profits;

143 iii) states that any provisions which differ from this Agreement are
144 offered by that Contributor alone and not by any other party; and

146 iv) states that source code for the Program is available from such
147 Contributor, and informs licensees how to obtain it in a
148 reasonable manner on or through a medium customarily used for
149 software exchange.

151 When the Program is made available in source code form:
152 a) it must be made available under this Agreement; and

154 b) a copy of this Agreement must be included with each copy of the
155 Program.

157 Each Contributor must include the following in a conspicuous location

167 4. COMMERCIAL DISTRIBUTION

169 Commercial distributors of software may accept certain
170 responsibilities with respect to end users, business partners and the
171 like. While this license is intended to facilitate the commercial use
172 of the Program, the Contributor who includes the Program in a
173 commercial product offering should do so in a manner which does not
174 create potential liability for other Contributors. Therefore, if a
175 Contributor includes the Program in a commercial product offering,
176 such Contributor ("Commercial Contributor") hereby agrees to defend
177 and indemnify every other Contributor ("Indemnified Contributor")
178 against any losses, damages and costs (collectively "Losses") arising
179 from claims, lawsuits and other legal actions brought by a third party
180 against the Indemnified Contributor to the extent caused by the acts
181 or omissions of such Commercial Contributor in connection with its
182 distribution of the Program in a commercial product offering. The

185 In order to qualify, an Indemnified Contributor must: a) promptly
186 notify the Commercial Contributor in writing of such claim, and b)

188 Commercial Contributor in, the defense and any related settlement
189 negotiations. The Indemnified Contributor may participate in any such
190 claim at its own expense.

193 product offering, Product X. That Contributor is then a Commercial
194 Contributor. If that Commercial Contributor then makes performance
195 claims, or offers warranties related to Product X, those performance
196 claims and warranties are such Commercial Contributor's responsibility
197 alone. Under this section, the Commercial Contributor would have to
198 defend claims against the other Contributors related to those
199 performance claims and warranties, and if a court requires any other
200 Contributor to pay any damages as a result, the Commercial Contributor
201 must pay those damages.

207 KIND, EITHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY
208 WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY
209 OR FITNESS FOR A PARTICULAR PURPOSE. Each Recipient is solely
210 responsible for determining the appropriateness of using and
211 distributing the Program and assumes all risks associated with its
212 exercise of rights under this Agreement, including but not limited to
213 the risks and costs of program errors, compliance with applicable
214 laws, damage to or loss of data, programs or equipment, and
215 unavailability or interruption of operations.

221 INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING
222 WITHOUT LIMITATION LOST PROFITS), HOWEVER CAUSED AND ON ANY THEORY OF
223 LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING
224 NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OR
225 DISTRIBUTION OF THE PROGRAM OR THE EXERCISE OF ANY RIGHTS GRANTED

228 7. GENERAL

230 If any provision of this Agreement is invalid or unenforceable under
231 applicable law, it shall not affect the validity or enforceability of
232 the remainder of the terms of this Agreement, and without further
233 action by the parties hereto, such provision shall be reformed to the
234 minimum extent necessary to make such provision valid and enforceable.

236 If Recipient institutes patent litigation against a Contributor with
237 respect to a patent applicable to software (including a cross-claim or
238 counterclaim in a lawsuit), then any patent licenses granted by that
239 Contributor to such Recipient under this Agreement shall terminate as
240 of the date such litigation is filed. In addition, If Recipient
241 institutes patent litigation against any entity (including a
242 cross-claim or counterclaim in a lawsuit) alleging that the Program
243 itself (excluding combinations of the Program with other software or
244 hardware) infringes such Recipient's patent(s), then such Recipient's
245 rights granted under Section 2(b) shall terminate as of the date such
246 litigation is filed.

248 All Recipient's rights under this Agreement shall terminate if it
249 fails to comply with any of the material terms or conditions of this
250 Agreement and does not cure such failure in a reasonable period of
251 time after becoming aware of such noncompliance. If all Recipient's
252 rights under this Agreement terminate, Recipient agrees to cease use
253 and distribution of the Program as soon as reasonably practicable.
254 However, Recipient's obligations under this Agreement and any licenses
255 granted by Recipient relating to the Program shall continue and
256 survive.

258 IBM may publish new versions (including revisions) of this Agreement
259 from time to time. Each new version of the Agreement will be given a
260 distinguishing version number. The Program (including Contributions)
261 may always be distributed subject to the version of the Agreement
262 under which it was received. In addition, after a new version of the
263 Agreement is published, Contributor may elect to distribute the
264 Program (including its Contributions) under the new version. No one
265 other than IBM has the right to modify this Agreement. Except as
266 expressly stated in Sections 2(a) and 2(b) above, Recipient receives
267 no rights or licenses to the intellectual property of any Contributor
268 under this Agreement, whether expressly, by implication, estoppel or
269 otherwise. All rights in the Program not expressly granted under this
270 Agreement are reserved.

272 This Agreement is governed by the laws of the State of New York and
273 the intellectual property laws of the United States of America. No
274 party to this Agreement will bring a legal action under this Agreement
275 more than one year after the cause of action arose. Each party waives
276 its rights to a jury trial in any resulting litigation.
