114 | rights and licenses granted hereunder, each Recipient hereby | |
115 | assumes sole responsibility to secure any other intellectual | |
116 | property rights needed, if any. For example, if a third party | |

118 | Program, it is Recipient's responsibility to acquire that license | |

146 | iv) states that source code for the Program is available from such | |
147 | Contributor, and informs licensees how to obtain it in a | |
148 | reasonable manner on or through a medium customarily used for | |
149 | software exchange. | |

236 | If Recipient institutes patent litigation against a Contributor with | |
237 | respect to a patent applicable to software (including a cross-claim or | |
238 | counterclaim in a lawsuit), then any patent licenses granted by that | |
239 | Contributor to such Recipient under this Agreement shall terminate as | |
240 | of the date such litigation is filed. In addition, If Recipient | |
241 | institutes patent litigation against any entity (including a | |
242 | cross-claim or counterclaim in a lawsuit) alleging that the Program | |
243 | itself (excluding combinations of the Program with other software or | |
244 | hardware) infringes such Recipient's patent(s), then such Recipient's | |
245 | rights granted under Section 2(b) shall terminate as of the date such | |
246 | litigation is filed. | |

248 | All Recipient's rights under this Agreement shall terminate if it | |
249 | fails to comply with any of the material terms or conditions of this | |
